  • AN ORDINANCE VACATING STREET RIGHT-OF-WAY FOR 6938-40, 6944-46 AND 6958 CEDAR AVENUE

The City of Richfield does ordain:

Section 1. The following described land has been dedicated to the public for street right-of-way purposes for Cedar Avenue:

The west 17 feet of the Cedar Avenue right of way from the easterly extension of the north line of Lot 7, Block 1, Cedar Sunrise Third Addition to the northeasterly continuation of the north right of way line of Diagonal Boulevard.

Section 2. The fee owner of the abutting land, Stephen Jensen, has petitioned for the vacation of that part of Cedar Avenue as described in Section 1 of this Ordinance.

Section 3. The area to be vacated is occupied by a public water main. Provided that a drainage and utility easement is reserved in favor of the City of Richfield, the proposed vacation of the street easement will not adversely affect the ability of the City to maintain, repair, or replace the utility located within the area to be vacated.

Section 4. The City Council finds that there is no longer a public need for street right-of-way over that portion of land as described in Section 1.

Section 5. The street right-of-way over that portion of Cedar Avenue, as described in Section 1 of this Ordinance, is hereby vacated; reserving, however, to the City of Richfield a drainage and utility easement over the area vacated.
