§ 605.31. Appeal; [licensee.]

  • Subdivision 1. Procedure. The licensee may appeal such suspension, revocation or nonrenewal to the City Council. The Council shall consider the appeal pursuant to the procedures set forth in section 1005.21 of this code. The Council may appoint a committee of the Council or an independent hearing officer to hear the matter, report findings of fact and a recommendation for disposition to the Council. Hearings on the appeal shall be open to the public and the licensee shall have the right to appear and be represented by legal counsel and to offer evidence in its behalf. At the conclusion of the hearing, the Council may order:

    (a)

    That the revocation, suspension or nonrenewal be affirmed; or

    (b)

    That the revocation suspension or nonrenewal be lifted and that the license be returned to the license holder.

    Subd. 2. Additional requirements. The City Council may base either suspension or issuance of the certificate upon any additional terms, conditions and stipulations which they may, in their sole discretion, impose.
