§ 1202.01. Definitions.

  • Subdivision 1. The definitions in this subsection will apply when these words and phrases are used in this chapter.

    Subd. 2. "Alcoholic beverage" means any beverage containing more than one-half (½) of one percent (1%) alcohol by volume.

    Subd. 3. "Brewer" means a person who manufactures malt liquor for sale.

    Subd. 4. "Brewpub" means a micro-brewery with a restaurant use operated on the same premises as the brewery.

    Subd. 5. "City" means the City of Richfield.

    Subd. 6. "Club" or "veterans organization" means an incorporated organization organized under the laws of the State for civic, fraternal, social, or business purposes, for intellectual improvement, or for the promotion of sports, or a congressionally chartered veterans' organization, which:

    (i)

    Has more than 30 members;

    (ii)

    Has owned or rented a building or space in a building for more than one (1) year that is suitable and adequate for the accommodation of its members;

    (iii)

    Is directed by a board of directors, executive committee, or other similar body chosen by the members at a meeting held for that purpose.

    No member, officer, agent, or employee shall receive any profit from the distribution or sale of beverages to the members of the club, or their guests, beyond a reasonable salary or wages as may be fixed and voted each year by the governing body.

    Subd. 7. "Cocktail Room" means an area for the on-sale consumption of distilled spirits produced at the distillery for consumption on the premises of the distillery or distillery-owned property adjacent to the distillery. A cocktail room may also include sale for off-premises consumption of distilled spirits produced at the distillery, subject to Minnesota Statute 340A.22, subd. 4 or its successor.

    Subd. 8. "Commissioner" means the commissioner of public safety of the State of Minnesota.

    Subd. 9. "Director" means the Director of Public Safety or the Director's designee.

    Subd. 10. "Growler" means a specially-designed 64 ounce or 750 ml beer container for exclusive off-sale of micro-brewery facility beer. A growler shall be packaged subject to Minnesota Statute 340A.285, or its successor.

    Subd. 11. "Hotel" means an establishment where food and lodging are regularly furnished to transients and which has:

    (i)

    A dining room serving the general public at tables and having facilities for seating at least 30 guests at one (1) time; and

    (ii)

    Not fewer than 125 guest rooms, each room having an area of no less than 150 square feet. (Amended, Bill No. 2008-8)

    Subd. 12. "Intoxicating liquor" or "liquor" means ethyl alcohol, distilled, fermented, spirituous, vinous and malt beverages containing more than 3.2 percent of alcohol by weight.

    Subd. 13. "Liquor stores" means the municipal liquor stores.

    Subd. 14. "Malt Liquor" means any beverage made from malt by fermentation and containing not less than one-half of one percent alcohol by volume.

    Subd. 15. "Micro-brewery" means a facility that produces for sale, distribution, and consumption beer, ale, malt liquor, or other beverages made from malt by fermentation and containing not less than one-half of one percent alcohol by volume, and which possesses the appropriate Federal, State, and Municipal licenses and which produces not more than 3,500 barrels of malt liquor in a calendar year. A micro-brewery may include a taproom.

    Subd. 16. "Micro-distillery" means a facility that produces Ethyl Alcohol, hydrated oxide or ethyl, spirits of wine, rum, brandy, gin, or other distilled spirits, including all dilutions and mixtures thereof, for non-industrial use in total quantity not to exceed 40,000 gallons in a calendar year. A distillery may include a cocktail room.

    Subd. 17. "Minor" means a person under the age of 21.

    Subd. 18. "Off-sale" means the sale of alcoholic beverages in original packages for consumption off the licensed premises only.

    Subd. 19. "On-sale" means the sale of alcoholic beverages for consumption on the licensed premises only.

    Subd. 20. "Restaurant" means an establishment, other than a hotel, under the control of a single proprietor or manager, where meals are regularly prepared on the premises and served at tables to the general public, and having appropriate facilities for serving no fewer than 40 guests at one (1) time.

    Subd. 21. The terms "sale" and "sell" and "sold" include and refer to all barters and all manner of furnishing alcoholic beverages, including such furnishing in violation or evasion of law.

    Subd. 22. "Taproom" means an area for the on-sale consumption of malt liquor produced by the brewer for consumption on the premises of a brewery or an abutting property in common ownership of the brewer, which may include sales of malt liquor produced and packaged at the brewery for off-premises consumption, subject to Minnesota Statute 340A.285, or its successor.

    Subd. 23. "3.2 percent malt liquor" means malt liquor containing not less than one-half (½) of one percent (1%) alcohol by volume nor more than 3.2 percent alcohol by weight.

    Subd. 24. "Wine" is the product made from the normal alcoholic fermentation of grapes, including still wine, sparkling and carbonated wine, wine made from condensed grape must, wine made from other agricultural products than sound, ripe grapes, imitation wine, compounds sold as wine, vermouth, cider, perry and sake, in each instance containing not less than one-half (½) of one percent (1%) nor more than 24 percent alcohol by volume for non-industrial use.
